General Terms and Conditions for In-house Events
Please note that for in-house events, the following General Terms and Conditions apply bindingly. We provide our services to you exclusively on this basis. This event offer is intended for companies and other commercial customers.
1. Services of the In-house Event
Augner Seminare will conduct for you the event specified in the in-house offer (training, workshops, etc.). Our services include the conception, preparation, and expert execution of the respective event as well as the provision of materials. Costs for conference technology and the training room are not included in the offer unless these have been provided by us.
a. Offers Including Expense Allowances
In principle, all expense allowances for our speakers are included in our event price. In this case, the event price is understood as a complete price plus VAT. This also applies to our online events.
b. Offers Excluding Expense Allowances
Offers excluding expense allowances are marked with the note “plus expense allowances.” In this case, expense allowances include all travel costs (by train, plane, or car) or transfer costs (e.g., taxi), catering expenses up to a maximum of €30 per event day, as well as, if applicable, accommodation costs including breakfast.
2. Binding Registration / Billing
After you place your order, you will receive a booking confirmation. Only then is a binding booking in place. If applicable, you will receive further information about the event in due time before it begins. A daily rate plus the statutory VAT is agreed for each event day. This daily rate is based on a total event duration of 8 teaching hours of 45 minutes each per day. Additional services (e.g., extensive pre- or post-event discussions) must be agreed upon separately. If expense allowances for the speaker incur, they will be billed after the event and, if applicable, invoiced separately.
3. Smooth Process: Organization of the Training Room, Technology, and Preparation
For in-house events, the organization of a suitable event space should generally be handled by the customer. In principle, the following are always required: a projector or large monitor, a flipchart easel, and a Metaplan board. Any additional requirements regarding conference technology will be communicated to you in writing after the event confirmation. To enable a tailor-made event, please provide us with all necessary information. If accommodation is required, this will be booked by Augner Seminare or, alternatively, can be arranged by the customer in consultation.
4. In-house Event at a Conference Venue Organized by Augner Seminare
If the in-house event takes place at a conference venue organized by Augner Seminare, in addition to the event fee, costs for a “conference package” will be incurred. The conference venue charges a conference package that includes conference and break beverages, snacks, and lunch, and, if applicable, dinner. These services will be invoiced to you by Augner Seminare as a conference package. Any required accommodation for the participants must be arranged by the customer. Please note that cancellation fees from the conference venue may be incurred if you cancel the event on short notice or do not appear. Your right to cancel up to 30 days before the event begins applies only to the event fee charged by Augner Seminare. The conference venue may have longer cancellation periods for its services (conference package/accommodation).
5. Cancellation
a. Cancellation of the Entire Event
Event at the Company
If you are forced to cancel your already booked event, please notify us immediately in writing (e.g., by fax or email). With a written cancellation up to 30 days before the event begins, no costs will be incurred by Augner Seminare. In the case of a later cancellation, we are entitled to charge the full event fee.
Instead of a cancellation, you have the option to propose an alternative date, thereby potentially avoiding cancellation fees.
Events at the Venue – Cancellation Fees
If the event is held at a venue organized by us, any cancellation fees incurred by the venue may be passed on to your company. Please note that in the event of withdrawal, cancellation, or rebooking, cancellation fees from the conference venue may start accruing from three weeks before the event begins. We have no influence over these fees. However, we will always try to avoid them for you as our customer or at least keep them as low as possible. The assertion of these fees against the customer is managed by Augner Seminare.
b. Cancellation of Individual Participants
The total price remains unchanged even if the number of participants changes.
If a hotel booking for a participant exists in one of our contracted hotels, any cancellation fees incurred by the conference venue may be passed on to your company. Changing the number of participants may also affect the conditions of the conference venue.
c. Cancellation of an Event by Augner Seminare
We reserve the right to cancel the event or individual bookings for important reasons, such as circumstances beyond our control (e.g., the illness of the speaker without the possibility of a prompt replacement or force majeure). Payments already made will then be refunded. Further claims against Augner Seminare are excluded, except in cases of intent or gross negligence.
6. Event Materials
In principle, every participant receives materials as part of the event. These are prepared to the best of our knowledge and expertise. However, liability or warranty for the topicality, completeness, and accuracy of the training materials is excluded.
The equipment available for in-house events may differ from that provided at external events.
7. E-Learning Offers
Every participant in our e-learning offers will receive individual credentials from us that enable access to the online content. Participation is only possible with these credentials. The use of the booked offer is limited to the respective participant and a specified period. The duration of use depends on the booked offer and can be inquired about with Augner Seminare. Sharing the access credentials with third parties is not permitted.
8. Liability in Case of Accidents
Participation in the event is generally at your own risk. During the event, participants are legally insured against accidents through their employer. Outside of event times and during activities as part of the accompanying program, this insurance does not apply. Our liability is limited to cases of intent and gross negligence.
9. Reservation of Rights to Amend
We reserve the right to make necessary content and/or organizational changes before or during the event, provided that these do not fundamentally alter the overall character of the event. If necessary, we are entitled to replace the initially designated speaker(s) with equally qualified persons.
10. Copyright and Usage Rights
The organizer retains all copyright and usage rights to the provided materials, software, and any other media supplied for the event. Reproduction, distribution, or any other use of the handed-out materials—even in part—is only permitted with the express written consent of the organizer.
11. Jurisdiction
The place of jurisdiction is Düsseldorf. The law of the Federal Republic of Germany applies, and the contract language is German.
12. Severability Clause
Should individual clauses of these conditions be found invalid, the validity of the remaining provisions shall remain unaffected.
